These Terms and Conditions ("Terms") govern your use of the Swoop mobile application operated by Shiv Krupa Restaurant Fastfood and Live Nasta, owned by Khoomaram G, at P-2784, Block 121/122, Vadi Vistar, Devadh, Varachha Road, Surat, Gujarat – 394210 (FSSAI Licence No. 20725022001531). By using the App, you agree to these Terms.
1. Eligibility
You must be at least 18 years of age to register and place orders. By using the App you confirm you meet this requirement.
2. Account Registration
- A valid phone number and email address are required to register via OTP.
- You are responsible for maintaining your account's confidentiality.
- One account per person. Creating multiple accounts to abuse promotions is prohibited.
3. Placing Orders
- Orders are subject to item availability and kitchen operating hours.
- All prices are exclusive of applicable taxes and displayed at checkout.
- Placing an order is a binding offer to purchase. Once payment is confirmed, the order is final.
- Please review your cart, address, and total carefully before tapping "Place Order".
4. No Cancellation & No Refund
We operate a strict no-cancellation and no-refund policy. Once an order is placed and payment is confirmed:
- The order cannot be cancelled for any reason.
- No refund will be issued for any reason, including dissatisfaction, wrong address, or customer unavailability.
- The only exception is an undelivered order due to a confirmed fault on our part — in which case a Swoop Wallet credit (not a cash refund) may be offered at our sole discretion.

5. Payments
- Payments are processed by Razorpay. Accepted methods include UPI, cards, and net banking.
- All transactions are in Indian Rupees (INR).
- Swoop Wallet balance may be applied at checkout as a partial payment.
6. Swoop Wallet & Cashback
- Cashback is credited to your Swoop Wallet after a delivered order based on the active reward configuration.
- Wallet balance is not transferable, not encashable, and may expire if unused.
- Swoop reserves the right to modify or discontinue the cashback programme at any time.
7. Delivery
Delivery is available within Surat only. Fees are calculated by distance. Estimated delivery times are not guaranteed. Please refer to our Shipping & Delivery Policy.
8. Reviews & User Content
- Reviews must be honest and based on genuine experience.
- Swoop may approve, reject, or remove reviews that are fraudulent, offensive, or misleading.
- By submitting content you grant Swoop a non-exclusive licence to display it in the App.
9. Prohibited Activities
- Using the App for unlawful purposes.
- Submitting false information or fake reviews.
- Attempting unauthorised access to our systems.
- Harassing or abusing delivery partners or staff.
- Misusing cashback, promotions, or wallet credits.
10. Promotions & Notifications
- Swoop may run promotional offers, festival deals, and cashback campaigns from time to time at its sole discretion.
- Such promotional communications may be delivered as in-app notifications within the Swoop application and/or as push notifications to your device.
- Swoop does not send promotional messages via WhatsApp, SMS, or email. If you receive such a message claiming to be from Swoop, treat it as unauthorised and do not act on it.
- Order status notifications (order placed, out for delivery, delivered) will be sent via push notification as these are transactional and necessary for service delivery.
- You may opt out of push notifications at any time through your device settings. This will not affect your ability to place orders, but you may miss order status updates.
12. Intellectual Property
All content on the Swoop App — including the name, logo, design, and code — is owned by Swoop / Shiv Krupa Restaurant and protected under Indian intellectual property law.
13. Limitation of Liability
- Swoop is not liable for delays caused by external factors (traffic, weather, etc.).
- Swoop is not responsible for allergic reactions where allergen information was not specifically communicated by the customer prior to ordering.
- Our total liability shall not exceed the value of the specific order in dispute.
14. Governing Law & Disputes
These Terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of the courts of Surat, Gujarat. We encourage resolving disputes amicably via support@justswoop.in first.
